After the Independent Medical Examination

You may be asked to undergo an examination by an independent medical expert. This blog explains what will happen and what your Decatur personal injury attorney will do.

Meeting with Your Decatur Personal Injury Law Firm Attorney
Whether or not you and your attorney have a meeting once the examination has taken place depends largely on whether or not you intend to initiate litigation. If so, then you will meet face to face as soon as possible so that your attorney can confer with you while the events are still fresh in your mind. If litigation is not intended, you should expect a telephone call from your lawyer in the days that follow in order to obtain your record of what happened.

Upon Receiving the Report
Once the independent expert has forwarded the results of the exam to your attorney, your lawyer will match it point for point with the reports from other medical personnel. He or she will also request that you read the expert’s report to see if you concur. Any minor errors or inaccuracies found in the independent medical expert’s report will be noted by your attorney and corrections or clarifications requested.

Inconsistencies
Once the comparison is made, any points of contention between the independent expert’s findings and those of your doctor will be reported to your doctor for refutation or corroboration and a meeting will be scheduled to discuss the matter. If it happens that your physician revises his or her position as a result of the expert’s findings, it could impact your settlement. Your doctor should provide your attorney with justification for either opposing or supporting the independent expert’s conclusions.
